Richmond, VA – Today, Liberty Counsel filed two briefs at the Fourth Circuit in Richmond in response to Bostic v. Rainey. One, submitted on behalf of WallBuilders, LLC, deals with the historical, legal, and philosophical reasons marriage is, and always has been, defined as the union of one man and one woman.
The other brief, filed on behalf of the American College of Pediatricians and Liberty Counsel, deals with the legal
arguments supporting the constitutionality of defining marriage as the union of one man and one woman, and the inherent harms associated with homosexual behavior. “Folks who define marriage as the union of one man and one woman are not motivated by animus,” said Mat Staver, Founder and Chairman of Liberty Counsel. “Rather, people believe in natural marriage out of a genuine concern for the well-being of homosexuals engaged in risky behaviors, as well as for America’s children and society. Studies show that children are most likely to grow up to be educated, productive citizens when they are raised by their married, biological parents,” Staver said.
In February 2014, Federal District Judge Arenda L. Wright Allen, an Obama-appointed judge, ruled that Virginia’s amendment defining marriage as one man and one woman was unconstitutional but immediately put same-sex marriages in Virginia on hold until Bostic v. Rainey can be heard by the 4th Circuit Court of Appeals. The appeals court will likely rule on this case by Labor Day.
“The overwhelming majority of Virginia voters affirmed natural marriage in the state Constitution. This is the first southern state in which a voter-approved, constitutional amendment was overturned by a single, secular judge who imposed her own viewpoints, rather than upholding the rule of law,” said Mat Staver. “Our Founding Fathers certainly never wrote a right to same-sex marriage into the Constitution. To say otherwise is ludicrous,” concluded Staver.
