General Questions

Can my employer legally ask about my vaccination status?
Yes

Isn’t it against HIPAA to ask my vaccine status / medical history?
Employers are prohibited by HIPAA from requesting an employee’s medical records from a third party, but HIPAA does not prohibit employers from asking the employee directly about vaccination status. They can require the tests/proof from the employees themselves. They cannot require the tests/proof from third parties, like the employee/s healthcare providers. While they can ask for your vaccination status, that knowledge must be kept confidential by a select few. I would object to having people outside of HR knowing about your status.

Can I be a part of the class action suit against the DOD?
Liberty Counsel filed a class action lawsuit against Joe Biden, the Department of Defense, and the Department of Homeland Security on behalf of members from all five branches of the military, as well as all federal employees and all federal civilian contractors, who have been unlawfully mandated to get the COVID shots or face dishonorable discharge from the military or termination from employment. If you fall into one of the categories above, you do not need to contact us about joining the lawsuit. The court has set an expedited preliminary hearing on our request to stop the COVID shot mandates. Read the lawsuit here.

Is the Veteran’s Administration covered under the Class Action Suit?

What if I am called into a face-to-face meeting regarding my religious exemption?
Take your personal religious exemption letter, Legal Memo, and our Memo regarding Questioning Religious Beliefs. Answer the questions honestly. If you are asked something you don’t understand or are unsure of how to answer, tell them you will get back to them about that question.

I have not been able to ask my question in any of the conference calls.  How can I get my question answered?
We have 500-900 callers on each call. The questions are answered in the order of how the callers called in. 

What to say if my church or religious leader is unable or unwilling to provide you me with ANY letter:
"My religious beliefs are sincere… Legally, I cannot be required to prove that a church or religious leader agrees with my sincere religious beliefs, or my interpretation of Scripture, or my instruction from the Holy Spirit. My beliefs are my own, and they are sincerely and deeply held."

What if my religious exemption was granted, but the conditions or "accommodations" are discriminatory?
If you believe that the conditions or "accommodations" that your employer or school requires instead of the vaccine are discriminatory or punitive or unnecessary, comply with them anyways, for the time being. Keep good written records of how much time and money these alternatives are costing you.

What if I am being bullied or discriminated against at work?
Keep good records of any instances of ostracism, ridicule, hostility, etc. that you face by being identified as a non-vaccinated employee or student (such as wearing a mask, or a badge, etc.)  In the future we hope to be able to address and potentially litigate discriminatory conditions or "accommodations."

What if I am asked to sign a document I don’t agree with?
If your employer or school provides a form or asks questions that are designed to make you affirm something with which you disagree, you can respond with the below statement before your signature if in print, or, if verbal: "I understand the above is your position. I am signing this document without waiver of my legal right to seek religious exemption and accommodation from any requirement that conflicts with my sincerely held religious beliefs, and without waiver of the right to seek legal redress from any wrongful denial of such exemption or accommodation."
