The city of Boston permits outside groups to fly their flags on special occasions on its city hall flagpoles. Since 2005, the city has hoisted more than 300 such flags.
Yet there’s one flag Boston bans. It’s even fighting in federal court to keep this flag off its flagpoles.

The city of Boston has created what it calls a “public forum” that is open, it claims, to “all applicants.” That gives civic and cultural organizations the chance to celebrate important events by having their flag displayed on the city’s flagpoles for a few hours. For Boston, all those flags are fine.
But not the Christian flag.
The city has twice rejected the request of our client, Boston resident Hal Shurtleff. He has been seeking permission for his Christian civic organization, Camp Constitution, to fly the Christian flag for less than two hours on Constitution Day!
But the city has denied the flag based on a secret, unwritten and unconstitutional "policy" of refusing religious flags.
A city official claimed in an email to Shurtleff that this "policy and practice is consistent with well-established First Amendment jurisprudence prohibiting a local government from 'respecting an establishment of religion.'"
Here’s the truth: Censoring religious viewpoints in a public forum where secular viewpoints are permitted violates the First Amendment. Boston city officials may not ban the Christian flag as part of a privately-sponsored event when they allow any other flag by numerous private organizations.
