The very same day Liberty Counsel filed suit against Virginia Governor Northam for his unconstitutional attacks on churches, local police stationed themselves outside our client's church, to scare would-be parishioners away.

We received another desperate call from Chincoteague Island, Virginia this weekend. As you know, our client Pastor Kevin Wilson is facing one year in jail and thousands of dollars in fines for deigning to open his church to 16 people who felt they needed the support of "in person" church. And as you also know, we filed suit in Federal Court Friday morning to not only protect Pastor Wilson, but to protect the constitutional rights of ALL churches in America from attacks by anti-Christian Governors.

Since that time, local police have remained stationed around the church, presumably monitoring all cars, license plates, and people who come near to the church. This has created what, in legal circles, is known as a "chilling effect" - an action that appears to threaten a person in such a way to induce them to abandon their legal rights. In the case of Lighthouse Fellowship Church – a church that has significant drug rehab and sex trafficking recovery programs – these "chilling effect" actions have scared parishioners from attending. And remember, the pastor was charged for having only 16 people in a 293-seat sanctuary – only 6 people over Gov. Northam's magic number of 10!
In another area of Virginia, a volunteer youth pastor must choose between abandoning his volunteer youth pastor role or risk his job, as his government security clearance could be taken away if the youth pastor receives a summons like Pastor Wilson did on Palm Sunday.
And in Louisiana, when a large poverty outreach church refused to stop serving the needy, a protestor admitted that he filed what appears to be bogus "assault" charges against a Pastor because he wants people to "demand that this place [the Pastor's Church], gets closed down." At least the protestor is being honest in admitting what these anti-Christian bigots really want – CLOSED churches...not just now, but always.
Governors and local tyrants keep trying to claim that they are simply "obeying CDC guidelines" for the so called COVID-19 crisis. However, the CDC draft guidance for "Communities of Faith" could not be clearer:
"This guidance is not intended to infringe on First Amendment rights as provided in the US Constitution." This sentiment is further explained, "The federal government may not prescribe standards for interactions of faith communities in houses of worship and no faith community should be asked to adopt any mitigation strategies that are more stringent than the mitigation strategies asked of similarly situated entities or activities in accordance with the Religious Freedom and Restoration Act," the proposal states, adding that the CDC "offers these suggestions that faith communities may consider and accept or reject, consistent with their own faith traditions, in the court of preparing their own plans to prevent the spread of COVID-19."
In other words, the Federal Government has made crystal clear to all state and local authorities that, per CDC guidelines: CHURCHES may accept or reject ANY of the CDC guidelines as they see fit and in accordance with their beliefs…and that governments may not interfere with those decisions.
Yet this week, we have a pastor under house arrest, we have an entire congregation on forced 14-day quarantine though none have COVID, and another Pastor, along with his flock, facing jail time or worse for practicing their faith in the way they see fit.
These attacks on our churches are not only illegal, and not only unconstitutional; they are an egregious affront to God Almighty and the faithful servants He commands.
The pastors we represent want to protect their people and the communities they serve, but they also want to provide some form of worship – be it a parking lot service or some limited in-person service consistent with health guidelines. They need our help.
