Liberty Counsel had a major win in the public realm yesterday when Vice President Mike Pence commented on our case against Virginia Governor Ralph Northam and his illegal ban on religious gatherings. Sadly, many governors remain insistent on robbing Americans of their Freedom of Religion.

Yesterday, in an interview with Fox News Radio with Brian Kilmeade, Vice President Mike Pence went on record siding with Liberty Counsel’s federal lawsuit on behalf of Lighthouse Fellowship Church in Virginia. The Vice President said that Virginia Gov. Ralph Northam’s sanctions on churches are “beyond the pale.”

Pence went on to elaborate on the administration’s position, saying “Even in the midst of a national emergency, every American enjoys our cherished liberties, including the freedom of religion.” Vice President Pence is right, of course, which is precisely why Liberty Counsel has filed suits in multiple states to keep religious freedom free.

But here’s the thing: America is a representative constitutional republic, which means neither the Vice President nor the President can simply order unruly governors to stop breaking the law and violating the Constitution.

Perhaps better than any administration in recent memory, the Trump White House understands that America is not a dictatorship and that such cases must be legally and constitutionally decided by the third branch of federal government – our courts.

This past Sunday afternoon, the U.S. Department of Justice filed a Statement of Interest (a legal brief) in our Virginia case, arguing banning religious gatherings while allowing secular gatherings violated the First Amendment. We are grateful for the DOJ and VP Pence!

But the governors just won’t stop! In a press conference when asked about our lawsuit, Maine Gov. Janet Mills said churches should not meet. Period!

Gov. Mills banned all in-person and parking lot services! Yet, she allows liquor stores, supercenters, big box stores, marijuana dispensaries, abortions clinics, and more to operate while jammed with people.

We are defending many churches and pastors around the country whose First Amendment rights are being violated. And, we are setting precedents that protect religious freedom.

Shockingly, right here in the “land of the free,” Liberty Counsel is actively representing, defending, and/or counseling hundreds upon hundreds of churches in nearly 40 states. Think about that a moment – pastors in the vast majority of American states have called upon Liberty Counsel to rescue our Constitutional right to freedom of religion.

The good news is, we are beginning to see some success with Kansas City, MO, and Orange County, FL, reversing their unconstitutional orders. And in both Kentucky and Virginia, the Department of Justice along with U.S. Attorney General Bill Barr have written briefs supporting our cases.

However, despite the welcome support of the White House and the Department of Justice, our legal system demands that the remedy to illegal actions by defiant governors is found in the judicial system. As a result, Liberty Counsel must continue our lawsuits on behalf of these beleaguered churches in order to ensure that no elected official or bureaucrat can steal American liberty – especially the First Amendment.

Liberty Counsel has filed federal lawsuits defending churches in multiple states. We will next be filing on behalf of Romanian churches. Many Romanian people fled that former Communist country to obtain the blessing of freedom, and yet now -- even here in the land of the free -- they face arrest and fines for worshipping together.

For many months now we have fought the most expensive case in Liberty Counsel history, the defense of “Baby Parts for Sale” whistleblower Sandra Merritt. That case is still ongoing. We currently have two cases before the Supreme Court and briefs filed in 4 other Supreme Court cases. And because Liberty Counsel’s legal services are always provided free of charge, our budget is severely stretched.
