Taking Illinois Tyranny to the Supremes

May 29, 2020

We've had a major victory in Illinois, but we have to still cross the goal line!

As you may already know from reading my recent comments, Illinois had the most restrictive, anti-church COVID-19 measures in the country. IL Gov. J.B. Pritzker not only insisted that churches could not meet for 12-18 months, our clients' churches were also threatened with "Summary Abatement," a process by which the city government could take immediate action to physically destroy, even bulldoze, our clients' church buildings if even one person set foot on the church property. All this even as our federal lawsuit against them was still unfolding!

In light of these drastic threats, Liberty Counsel bypassed the Federal Appeals Court this week and requested an Emergency Injunction directly from the U.S. Supreme Court, in order to prevent Pritzker and company from bulldozing the church buildings…and to restore religious freedom.

Here's the miracle!

Less than four hours before Pritzker was due to submit a defense of his illegal actions to the Supreme Court, Gov. Pritzker ABANDONED ALL RESTRICTIONS AGAINST CHURCHES! This restoration of Illinois' religious freedom is a direct result of Liberty Counsel dragging the defiant Governor to the steps of the U.S. Supreme Court!

The unilateral actions of Gov. J.B. Pritzker are a classic example of tyranny. He knew he did not have authority to trample on the First Amendment rights of churches and houses of worship, but he did it anyway and continued to do so until Liberty Counsel intervened.

We are honored and blessed to have been able to act as the "tip of the spear" in the fight for God's people, but sadly this battle has only just begun...

Gov. Pritzker's unexpected 180-degree turnabout mere hours before he had to give an account to the Supreme Court cannot be trusted. This change was occasioned only because Pritzker feared becoming the face of a national precedent against tyrannical governors who have imposed draconian restrictions against churches. His sudden change cannot be trusted to be permanent, especially given his repeated warnings of a "second wave" of COVID outbreaks during which he could shut down churches again.

Unless and until there is a judicial declaration that Gov. Pritzker has acted unconstitutionally thus far, there is nothing keeping him from changing his mind again, whether in this or another crisis.

Liberty Counsel has filed a reply to the Supreme Court arguing that Gov. Pritzker's unconstitutional orders are capable of repetition, yet evading review. Also, that his supposed voluntary cessation of these orders on churches does not moot the case, because he unilaterally issued the orders and aggressively enforced them and then repealed them. He could just as easily reinstate them!

Governor Pritzker cannot be trusted to obey the Constitution…and neither can many other Governors who have also grossly abused the Constitutional rights of the churches we represent.

The Supreme Court MUST act to ensure no tyrannical governor ever again—not next week, not next fall, and not the next "flu" outbreak—is able to destroy Americans' right to religious freedom.

LAST THING: Our ongoing defense of Sandra Merritt, the brave whistleblower who exposed Planned Parenthood's gruesome "Baby Parts for Sale" scheme, has been the most expensive case in Liberty Counsel litigation history.

Our other cases, like defending Kentucky clerk Kim Davis, or the sidewalk counselors who pray outside abortion clinics, are all ongoing even as we have taken on this new work of defending literally thousands of pastors under attack for exercising their First Amendment right to hold church services.

One hundred percent of all donations go directly to our legal program, not fundraising. But our budget is stretched as never before. Please, give as generously as possible TODAY so that our children and grandchildren will experience religious freedom tomorrow. Select here.
