Some commanders in the military are disregarding the classwide court-ordered protection against the shot mandates. This lawlessness extends from Joe Biden to the Department of Defense (DOD) to some top brass.

Yesterday morning, I received yet another desperate plea from an active-duty service member whose command is violating a federal court order. It was just one among many we are receiving, now that Liberty Counsel has won a classwide injunction protecting religious exemption-seeking Marines from punitive treatment.
It appears Joe Biden, the Department of Defense (DOD) and some commanding officers have no intention of obeying the federal courts. But that will soon change. The rule of law will prevail.
Jack* wrote, “despite email/guidance from Liberty Counsel on the court order from Judge Merryday for the Marine Corps and the email/guidance from the SJA informing the command to cease the ADSEP [Administrative Separation] process (for all Marines denied religious accommodation) our command will continue the ADSEP process.”
According to the USMC website, an ADSEP is the way the Marine Corps fires people.
Judge Merryday’s order forbids the Marine Corps or the DOD from discharging or punishing the brave Marines who choose to exercise their religious freedom right to reject the COVID jabs.
But this Marine’s treatment appears to be nothing compared to the outrageous defiance being reported in the Navy.
While the Marine Corps is trying to push faithful religious adherents out as fast as they can be processed, the Navy is STILL punishing religious exemption seekers into compliance. Instead of booting them, the Navy is holding these sailors in what can only be described as hellish conditions. The Navy will not let them leave … unless the sailors deny their religious accommodation requests (RAR).
Phillip* filed for his religious exemption last year. The Navy then moved Phillip and other religious exemption seekers to an old berthing barge in a nearby naval yard, and left them there, forbidding the faithful religious adherents from leaving the area, or the Navy.
Phillip supplied the court with pictures of the deplorable conditions where he and his shipmates are forced to live. Mold coats the walls and floors. Raw sewage regularly seeps up through shower drains, spilling across the floors and pooling under sailor’s bunks.
Toilets are largely inoperable. Photos of toilet bowls are half filled with what looks like mud but is, in fact, rotting feces.
“The conditions on the barge are deplorable,” wrote Phillip. “There is some sort of worm thriving in the stagnant water in the toilet bowls and on the floor in the leaked water around the base of the toilets.”
Phillip has to mop the stinking mess from under his bunk daily. “Needless to say, I do not feel comfortable or safe in this environment and I have contacted mental health services multiple times,” he wrote.
All Phillip must do to escape this floating hell is to deny his faith and accept the COVID jab Joe Biden’s DOD insists upon.
Given the conditions, "I do want—desperately—to be separated from the Navy as soon as possible,” said Phillip, “but I struggle with withdrawing my request as I feel it could signal that my religious objection was somehow not genuine, and it is.”
“It feels wrong to have to renounce my beliefs in order to get the Navy to separate me,” says Phillip.
Judge Merryday’s order was crystal clear: “Obviously, RFRA [Religious Freedom Restoration Act] includes everyone from the President to a park ranger, from the Chief Justice of the United States to a probation officer, from the Speaker of the House to a member’s district office staffer, from the Chairman of the Joint Chiefs of Staff to a military recruiter — even if they do not like it and even if they do not agree with it. The Free Exercise Clause and RFRA are the law of the land.”
Currently, the Marines, Navy, Air Force and Space Force all have orders issued by federal courts FORBIDDING any punitive or disparate treatment of military members exercising their right to refuse the jabs. Liberty Counsel continues to seek class certification and protection for the Army and the Coast Guard as well. I will update you on those cases as soon as I can.
Biden and his administration continue to behave as if there is no authority other than their own. This will not go well before the court.
This gross mistreatment of our military service members gives credence to the idea that Biden truly is trying to purge from the military all religious adherents who answer to a higher Authority.
Liberty Counsel WILL NOT TOLERATE this unlawful treatment of our brave heroes. We have put Biden’s DOJ (Department of Justice) on notice to IMMEDIATELY get their commanders under control, or we will seek contempt of court charges if they do not comply.
