Yesterday, I presented oral argument at a federal Court of Appeals defending members of the U.S. military from Joe Biden’s unlawful shot orders and the shocking abuse of soldiers, sailors, airmen, guardsmen and Marines.  

The argument went well. The Department of Defense (DOD) continues to rehash the same old narrative the courts have rejected. I am astounded at the lack of legal reasoning and disrespect for the law. 

Please keep our cases in prayer. At the same time I presented this argument on behalf of a Lt. Colonel in the Marine Corps and a Commander of a Navy Surface Warship, we were also preparing for our trial in January on behalf of the entire class of Marines. The story I share below is about the Commander. I wish you could meet this outstanding officer. We will never stop fighting for these wonderful defenders of freedom who love God and love America. As commanding officer of his unit, Charles* personally endorsed 16 religious accommodation requests (RARs) for the sailors that serve under him. But the Navy unlawfully denied every one of those requests, as well as Charles’ own request for religious exemption. 

Sworn to defend the Constitution, Charles is now being punished for demanding the Constitution be upheld. 

Charles* is the commanding officer of a U.S. Navy guided missile warship. For just under one year, including during deployment, the men and women aboard Charles’ warship successfully executed all mission requirements throughout the height of the COVID “crisis” without a vaccine.  

Charles says the health protection protocols the Navy executed proved successful during this time. No sailors under Charles’ command became seriously ill or died from the virus.  

But Joe Biden’s mandate is forcing every faithful religious adherent out of the military, including the Navy, which Charles has served so well for nearly two decades. 

“I never thought I would be placed in the position of conflict between my faith and a military order,” says Charles, who was forced to “decide whether to remain true to what God wants me to do or be kicked out of the service.”

We have heard this heartbreaking story too many times in the 18 months since Joe Biden announced his unlawful shot mandates. “I love both God and the Navy,” says Charles and many of our other plaintiffs, who just “want to be able to remain true to my beliefs, and continue to serve,” according to Charles. 

Joe Biden’s DOD has steadfastly refused to grant almost every religious exemption filed. But a review of court-ordered DOD records shows that the Biden administration DID grant hundreds, if not thousands of NONRELIGIOUS medical exemptions to the shot. 

By allowing unvaccinated members to continue to serve, the administration tacitly admits that the unvaccinated pose no threat to the troops. But it is deeper than that. By granting medical exemptions while issuing blanket denials for religious exemptions, Biden’s DOD is admitting something else—its antireligious bigotry. 

When Charles joined the service, he took an oath to protect and defend the United States Constitution. As a commanding officer, Charles is also obligated to protect the rights of the men and women who serve under his command.

Charles is the highest-ranking officer in the Navy to request a religious exemption to Joe’s jabs. As such, Biden’s DOD has decided to “make an example” out of him for daring to claim the rightful religious freedom due to himself and the sailors under his command. 

Several months ago, Liberty Counsel was able to secure a preliminary injunction protecting Charles from Biden’s purge. Yesterday, I presented arguments at a federal Court of Appeals, defending the protective order against the DOD and DOJ (Department of Justice) who want it undone. 

NO ONE should be forced to follow an unlawful order that defies both faith and the law—especially not the brave men and women who defend OUR freedom every day. 

There is much work left to do on this case, and we seek full justice for our military service members.
