Parents Arrested for Using State-Issued Vax Exemption
A pro-vax pediatrician falsely reports parents for “neglect” even though they had a religious exemption to vaccinate their children.
Massachusetts state law allows parents to seek and receive religious exemption from vaccination. Isael Rivera and Ruth Encarnacion dutifully sought and received such a religious exemption for each of their five children, aged 9 months to 10 years.
But a local pediatrician disagreed with the parents’ decision not to vaccinate their baby, so he reported the homeschooling parents to the state’s Department for Children and Families (DCF), falsely alleging “neglect,” despite the fact that his own written record of the children’s examination showed the children were perfectly healthy.
Isael and Ruth were thrown in jail, and all five children were taken by MA Child Protective Services, for using their state-issued vaccination exemption!

Just days after the pediatrician filed his report, DCF agents and police surrounded Isael and Ruth’s apartment. Isael and Ruth refused to turn over their children, and instead they fled Massachusetts for Texas — a state known for honoring parental rights.
Massachusetts DCF charged the parents with “kidnapping” their own children, in addition to the “neglect” charges that resulted from the family’s choice to exercise their state-protected right to reject childhood vaccines.
This case reflects a disturbing trend — medical ideologues and state-level bureaucrats refusing to honor parental rights or clearly written law, instead removing children from perfectly healthy homes.
A new Centers for Disease Control (CDC) report proves parents have a right to be concerned about vaccines.
In the 1970s, autism occurred in just 1 in every 10,000 children.
By 1986, autism was still relatively rare, with just over 1 in every 1,000 children being diagnosed with the disease.
Fast-forward and CDC figures (2022) show that 1 in every 31 children have autism.
In California, which has the strictest vaccination mandates in the nation, the rate of autism in 1 in every 19 children.
In Texas, which allows religious exemptions, only 1 in every 103 children have autism.
What changed? The CDC’s childhood vaccination schedule.
- In 1986, the CDC required 12 shots before the age of 18.
- By 2019, the CDC ordered children to get 54 shots by 18.
A plot graph tracking autism rates shows that as CDC vaccines increased, so did autism rates.
Thanks to pharmaceutical industry pressure, Congress passed a law in 1986 protecting all vaccine makers, indemnifying them against any and all damages their vaccines cause.
As a result, drug companies began flooding the market with all kinds of new vaccines — and getting the CDC to require those vaccinations. And millions of parents and families are now paying the price.
Don't let the government force children into autism!
Protect parental rights and religious freedom today.
“Science” — especially science funded and promoted by drug makers who have nothing to lose other than profits — is never infallible.
Religious exemptions allow parents to protect their children from physical harm as well as any attacks on the family’s religious beliefs.
But despite clear laws protecting religious liberties, many doctors believe they are above the law, and make state agencies, like the MA DCF, view parents as mere caretakers whose religious freedom rights do not apply.
In some ways, this case reminds me of Kim Davis in Kentucky. Kim, as you may recall, is presently being sued into bankruptcy for daring to use her legal and rightful religious exemption.
If people can be sued and arrested for using their religious freedom rights, then America really doesn’t have religious freedom at all.
Liberty Counsel has been fighting to protect religious freedom, including religious exemptions from vaccines and other medical experiments (like the COVID jab), for over 36 years. We’ve won 40 cases we have argued or briefed before the U.S. Supreme Court and thousands more in state and appeals courts. But we need your immediate financial support to continue this fight.
We never charge our clients because we know that most people could never afford to fight rogue government officials on their own. A Challenge Grant has been established to support our legal fund by doubling the impact of every donation made today. Please, give generously so NO parent ever again has to choose between keeping their children or their religious freedom rights. Every gift will be DOUBLED by our Challenge Grant.
