The SPLC’s efforts to “completely destroy” Liberty Counsel have gone on for years, spanning three continents and seven countries. Our legal team has spent more than 10,000 hours reviewing over 186,000 documents and taking 25 depositions that included over 11,000 pages of exhibits and 6,800 pages of transcripts. Then, after engaging in all that time-consuming discovery, Liberty Counsel was forced to expend significant efforts preparing a motion for summary judgment that included a 174-page statement of facts and 142-page legal memorandum, all supported by nearly 6,000 pages of exhibits.

As I write this email, we are preparing our final response to the SPLC that will be filed later this month. Then the judge will make a ruling.

In the entirety of that massive record, there is not a shred of evidence against Liberty Counsel. Absolutely NOTHING!

But the SPLC has a billion-dollar endowment, and they are using it to engage in lawfare. Lawfare is the detestable practice of abusing and manipulating the legal system to harm an innocent opponent. In this case, the SPLC used its massive endowment to hire boatloads of lawyers, who, in turn, have tried to bury us under mountains of paperwork to prevent us from doing our real work — fighting for life, religious freedom, and the natural family.

SPLC’s client, Janet Jenkins, claims that Liberty Counsel helped “kidnap” the daughter of her former partner, Lisa Miller. This is categorically UNTRUE, as is irrefutably proven in the hundreds of thousands of documents provided to the court. Our innocence is also proven via the sworn testimony of the four people who were convicted of helping Lisa Miller and her daughter.

• “Lisa Miller’s undisputed sworn testimony is that in June 2008, Liberty Counsel attorneys were continuing to advise her that she was required to comply with court orders and that serious consequences would result if she failed to permit the court-ordered visitation, but that Lisa Miller chose non-compliance on her own, despite the advice she was receiving from Liberty Counsel.”
• “Lisa Miller likewise testified under oath that she did not inform Liberty Counsel or [Rena] Lindevaldsen of her alleged plans to flee the country with Isabella Miller.”
• “[Philip] Zodhiates confirmed that Liberty Counsel did not know or approve of Lisa Miller’s intent to kidnap Isabella Miller and flee the country, did not know of or approve her plans, and did not assist any person or entity with regards to Lisa Miller’s actions.”
• “Kenneth Miller’s undisputed sworn testimony is that he has no direct, personal knowledge that Liberty Counsel, Mathew Staver, or Rena Lindevaldsen ever assisted Lisa Miller with disappearing from the United States, in planning Lisa Miller’s fleeing from the United States, or in helping Lisa Miller remain hidden from the United States.”

After years and digging through hundreds of thousands of Liberty Counsel files and documents, the SPLC knows that Liberty Counsel did nothing wrong. But the SPLC continues its attack after all these years because they want to destroy us.

Since 1989, Liberty Counsel has won 39 cases we have argued or briefed before the U.S. Supreme Court. Our work helped overturn Roe v. Wade, restore the Ten Commandments, end government censorship of Christian speech, and overturn the “Lemon Test,” among other things.

No wonder these haters of life and liberty want to destroy us — we are effective!
