Sandra Merritt exposed one of the biggest scandals in the history of America. Congressional committees of the U.S. House and Senate conducted hearings. Referrals were made to the U.S. Department of Justice to prosecute. And now, the Ninth Circuit Court of Appeals may have just delivered the key to keep Sandra out of prison. But this case is now being reconsidered by the entire court.

Sandra Merritt’s undercover videos exposed Planned Parenthood performing banned abortion techniques and unlawfully harvesting and selling the aborted organs from aborted babies – some which were harvested while they were still alive.

Sandra’s videos resulted in judgments against several organ procurement companies that purchased the abortion giant’s grim products. But not one Planned Parenthood executive or doctor was ever charged. Instead, Sandra Merritt faces years in prison if convicted and 16 million dollars in civil fines!

Orange County, California, District Attorney Tony Rackauckas filed suit against some of the companies Sandra exposed, including DaVinci Biosciences and its sister company, DV Biologics, for advertising and selling “hundreds of units of fetal tissue and stem cells to research facilities around the world, collecting tens of thousands of dollars in revenue.”

The DA’s office published a sample price list for the baby body parts: (1) Heart – up to 674 dollars in profit; (2) Liver – up to 233 dollars in profit; (3) Stomach – up to 221 dollars in profit; and (4) Small Intestine – up to 664 dollars in profit.

From 2009 to 2015, the defendants obtained aborted baby organs from Planned Parenthood and turned those donations into a profit-driven business. They did so by selling hearts, lungs, kidneys, brains, intestines, skeletal muscles, and bones of the aborted babies, earning hundreds of thousands of dollars in revenue.

The defendants pressed onward, year after year, to beat their “competition” and increase margins. They were encouraged to offer discounts, coupons, and sale-pricing on fetal products to move “inventory” more quickly.

Some of the companies that bought Planned Parenthood’s baby body parts were ordered to pay fines up to 7.8 million dollars. Some shuttered their doors. Others continue operation to this day. But NO ONE at Planned Parenthood was ever charged with a crime.

Instead, Sandra Merritt, whose undercover videos were used in evidence in the organ procurement companies’ cases, is the one facing up to 10 years in prison, and 16 million dollars in civil fines — all for exposing a crime.

The politically motivated criminal case against Sandra is ongoing, as is the multimillion-dollar civil lawsuit filed by Planned Parenthood. The videos and prior hearings in these cases reveal the Jezebel spirit at work.

Dr. Theresa Deisher, an expert in adult stem cell research who obtained her Ph.D. in molecular and cellular physiology from Stanford University School of Medicine, revealed how horrified she was upon reading various studies involving baby human hearts procured from StemExpress and sourced from Planned Parenthood. Dr. Deisher knew those studies had to be conducted while the hearts were still beating when cut out, without anesthesia, from the aborted babies.

The abortionists admitted to and even bragged about their crimes — and the massive profits they were making committing those crimes.

Videos showed freshly “harvested” baby limbs, organs, and eyeballs spread out in a common baking dish, ready to be shipped to the highest bidder.

But only Sandra now faces prison — up to 10 years behind bars — and a 16-million-dollar civil case Planned Parenthood brought against this brave grandmother-turned-undercover journalist.

Now a Ninth Circuit Court of Appeals decision might free Sandra once and for all.

The court ruled in Project Veritas v. Schmidt, that an Oregon law banning surreptitious recordings of conversations is a content-based restriction that violates the First Amendment and is invalid.

The three-judge panel reversed the district court’s dismissal of a complaint challenging, as an unconstitutional restriction of protected speech, Section 165.540(1)(c) of the Oregon Revised Code, which generally prohibits unannounced recordings of conversations, subject to several exceptions. But now the entire panel of judges voted to rehear the case. The battle is far from over.

California’s recording law, which was used to justify the charges against Sandra Merritt, is substantially similar to the Oregon law the Ninth Circuit just struck down. Like the Oregon law, California’s law and its exceptions “draw a distinction between topics” and whether the recorded conversation is a “confidential communication.”

Since California Penal Code Section 632(a) is nearly identical to Oregon’s unconstitutional statute, it is similarly unconstitutional.
