Two Rivers Public Charter School in Washington, D.C., didn’t object when Planned Parenthood built a 26,000-square-foot abortion grist mill right next door to the school’s elementary and middle schools. Even when the clinic began killing babies right next door to the school’s 3- and 4-year-old preschoolers, the school never complained, and they certainly never sued the abortion giant.

But when our client, Larry Cirignano, stood on the public sidewalk in front of Planned Parenthood for one single day with a sign about ending violence against the unborn and children, the school sued him. Liberty Counsel stepped in to defend Larry.

Larry’s sign did not have pictures showing the gruesome reality of abortion, nor did he harass or intimidate anyone. His quiet protest was entirely peaceful. Yet, the charter school contended that Larry’s peaceful, pro-life witness (not the murder of unborn children right next door) caused "emotional distress" and was a "nuisance" to the school.

When Larry raised the alarm that a killer was in the midst of children, Two Rivers sued to silence him. You would think that those who run schools would want to protect children, not kill them.

Liberty Counsel has been fighting this case for nearly a decade. Every time Two Rivers lost, the school doubled down, dragging Larry and this case all the way to the Circuit Court of Appeals for the District of Columbia, which, once again, sided with Larry, Liberty Counsel, and freedom of speech.

After dragging Larry through nearly a decade of litigation and having been found by the Court of Appeals to violate his constitutional rights, the school now claims it should not have to pay for its unconstitutional actions.

Yet this school’s administration pursued a lengthy legal battle to try to deny Larry his First Amendment right. And this school chose to fight Larry every step of the way, including on appeal for nearly 10 years.

The law is clear, individuals and entities may not use lawfare to rob others of their constitutional freedom. Sadly, the only way to stop this abuse of the legal system and threats to liberty is to financially punish the perpetrators.

Had almost any other law firm in the country been representing Larry, he would be bankrupt by now.
