Court orders Congress to fund Planned Parenthood

On July 28 of this year, U.S. District Judge Indira Talwani ignored the recent U.S. Supreme Court ruling that prevents lower court judges from issuing nationwide injunctions. The court ruled that Congress cannot defund abortion. This is unbelievable!

Talwani issued an injunction preventing Congress from defunding Planned Parenthood and Big Abortion, despite the defunding provisions passed into law as part of the One Big Beautiful Bill Act (OBBB).

Once again, Liberty Counsel will fight back.

Even the Washington Post board agrees that Judge Talwani overreached her authority.

An article published July 29 notes that Judge Talwani’s order “blocked an act of Congress — not an executive order, but legislation.” WaPo said, “Allocating public money is Congress’ core competency.” Yet, Judge Indira Talwani “countermanded Congress” by issuing this injunction. “This is what judicial overreach looks like,” the article rightly proclaims.

Chief Justice John Roberts mentioned in his Obergefell v. Hodges dissent, that “Under the Constitution, judges have power to say what the law is, not what it should be.”

Judge Talwani has no authority to commandeer both the executive and legislative branches of government. For that reason alone, this ruling MUST be overturned if our republic is to survive.

Planned Parenthood’s money troubles began BEFORE Congress defunded them.

Now they want YOU to make up the difference.

Before the One Big Beautiful Bill, which defunded large abortion providers, Planned Parenthood had already closed at least 20 abortion clinics.

Between January 1 and June 1, 2025, the abortion giant closed abortion clinics in Illinois, Iowa, Michigan, Minnesota, New York, Utah, and Vermont.

While some of these closures may have been the result of Title X restrictions implemented earlier this year, that is not the case for all. In Michigan, for example, four clinics closed, and 10% of the workforce was laid off despite the fact that Michigan did not abide by Title X funding restrictions.

Planned Parenthood of Greater New York (PPGNY), by the end of 2024, had already closed four of its clinics due to declining revenues.  

In June — over a month before the OBBB passed — PPGNY announced it was selling its only Manhattan-based abortion clinic because the clinic is losing money at an alarming rate.

In 2024, the Manhattan clinic had a 31 million-dollar shortfall, according to Wendy Stark, president and CEO of PP of Greater New York.

“Here we are, a few years post-Dobbs, and you’re seeing health providers in [abortion] access states really struggle financially,” Stark said before the OBBB passed.

In the weeks running up to the OBBB passage, PP USA claimed the cuts would shutter 200 more of its abortion clinics nationwide.

As of June 2023, according to its annual report, Planned Parenthood had over 3 billion dollars in assets.

So why must taxpayers foot the bill for its unholy practices?

Planned Parenthood’s lawsuit alleges it is the specific target of the OBBB restrictions. But that is simply not true. While Planned Parenthood is the largest abortion provider in the country, it is NOT the only abortion mill to lose funding under this bill.

The OBBB, signed into law on July 4, 2025, prevents ANY abortion provider who receives more than 800,000 dollars a year in federal reimbursements from receiving Medicaid funding for one year.

Frankly, I don’t think the OBBB went far enough. Any moratorium of taxpayer funding of abortion should be permanent, not just for one year. And the moratorium should not be limited to abortion giants. Taxpayers should not be forced to pay for abortion at all, ever.

But the world’s oldest and largest baby-killing mill can’t stand the thought of losing access to YOUR money. So it is suing. But Liberty Counsel will fight Planned Parenthood every step of the way.
