Liberty Counsel Wins Injunction Against Oakland, CA, Public Schools

But the school district stubbornly persists in discrimination against Christians despite receiving a federal injunction!

After COVID, the Oakland United School District (OUSD) in California forbade Child Evangelism Fellowship’s (CEF) Good News Clubs from meeting on school grounds, even as the district promoted and celebrated LGBTQ groups. Excuses abounded, but few were as telling as the school district administrators telling CEF they did not want "evangelism on our campus."

We just beat OUSD in court, but the school is still trying to discriminate against Christian kids and families! So, even though we won an injunction in court, Liberty Counsel is not done teaching this school a lesson about the First Amendment.

Two weeks ago, on August 15, Liberty Counsel secured an injunction against the OUSD. U.S. District Judge Haywood S. Gilliam Jr. ruled the school district’s attempt to ban the Good News Clubs was blatant viewpoint discrimination and ordered the school district to reverse its unlawful policy.

The judge’s ruling is no surprise. After all, Liberty Counsel’s 9-0 U.S. Supreme Court win in Shurtleff v. City of Boston proved once and for all that government entities MAY NOT discriminate against Christian viewpoints.

But Oakland School District administrators remain defiant!

In a statement delivered after the judge ruled against the OUSD, a spokesperson for the district told reporters that “Oakland Unified School District supports the right of inclusive, non-discriminatory groups to have access to public lands such as public-school property for the exercise of their First Amendment rights to assembly and free expression.”

In other words, even after being sued and slapped with a federal injunction for its unconstitutional discrimination, OUSD STILL believes that the Constitution allows the government to exclude "non-inclusive" and "discriminatory" groups (Christians who don't bend the knee to the government's prescribed orthodoxy) from public spaces.

OUSD’s actions are against the law and in total violation of the federal injection just slapped on them.  

Liberty Counsel is already preparing for the next round of this court battle.

By the way, the OUSD has no problem with LGBTQ clubs. In fact, the school district’s website encourages children to attend “Rainbow Clubs” for “LGBTQ programming” (emphasis added). The district’s use of the word “programming” is significant — and no accident. 

From the earliest age, these “Rainbow Clubs” teach children as young as preschool age that deviant behavior, hormones, and mutilating surgeries are normal.

These clubs promote deviant sexual behaviors and the irrational, unscientific idea that one can be “born in the wrong body,” while encouraging children to disregard the traditional and scientifically correct views on gender of their parents and “older generations.” 

Independent research performed by George Barna reveals that a person’s moral foundations are generally in place by age 9, albeit with some adjustments. These values are formed early.  

Barna also found that a person’s response to the meaning and personal value of Jesus Christ’s life, death, and resurrection is usually determined by age 18, and often earlier, by age 12. 

LGBTQ proponents — unable to reproduce — must recruit new members to their cult by “programming” innocent young minds. And they are unlawfully BANNING Christian clubs that might prevent or interrupt the LBGTQ “programming” of these precious children.  

CEF serves as a counter to this cult programming, providing wholesome, uplifting biblical truths that help children grow into happy, well-adjusted godly men and women.  

Liberty Counsel has defended CEF for 25 years, and we have NEVER lost a case. But radicalized LGBTQ school districts keep trying to violate clear federal law, and in this case, a plainly written judge’s order to silence the Good News of Jesus Christ.
