This will be the fifth time the Supreme Court has conferenced on this case, meaning there is high interest among the Justices and a strong likelihood the Court will take up the full case this session.

The Case: Does v. Hochul

John*, a faithful Christian who runs a small senior living center in New York, was told he and his staff must violate their religious convictions or lose their jobs and business licenses. Despite clear federal protections under Title VII of the Civil Rights Act, Hochul ordered employers to deny ALL religious exemptions to the COVID shot — or face daily fines, license revocation, and forced closure.

This is a direct violation of federal law, and it’s not just affecting John. Thousands of health care workers were fired for refusing the shot on religious grounds. Hochul allowed medical exemptions — but unlawfully banned religious exemptions.

Another of our plaintiffs had received a religious exemption from vaccines, including COVID, from the State of New York for each of the last 10 years. But despite the fact that this employee worked remotely, from his own home, and never interacted with his colleagues or employer in person, his exemption was revoked during COVID and he lost his job, thanks to Hochul’s abuses.

The Danger: States Overriding Federal Law

If Hochul’s actions go unchecked, any state could pass laws that contradict federal protections — including those against racial, religious, and sex-based discrimination.
