SCOTUS Dodged Kim Davis’ Case 

But the fight to overturn Obergefell continues

By sidestepping Kim Davis’ petition, the High Court missed a huge opportunity to correct its abominable opinion in Obergefell v. Hodges. That opinion of “five lawyers” has no connection to the Constitution, and it is a rebellious insult to God who created us in His image — male and female.

This time, Kim Davis is the victim of religious animus and is being deprived of her constitutional freedom of religion by the vindictive LGBTQ agenda. Tomorrow, it could be you.

That’s why Liberty Counsel will not give up the fight to overturn Obergefell. We cannot allow one wrongful opinion to obliterate constitutional religious freedom rights.

Today, I am in Texas speaking to hundreds of Christian state lawmakers on this critically important issue. It is not a matter of IF, but WHEN Obergefell will be overruled. Mark my words!

Kim Davis was Obergefell’s first victim. The opinion that enabled same-sex marriage was also used to deny Kim her First Amendment right to religious freedom and free speech.

Two men, angry that they could not force Kim to personally sign their “marriage” certificate, will now try to collect several hundred thousand dollars in judgments against her, simply because she dared to exercise her constitutionally protected religious freedom rights.

Our case now continues in the lower courts, defending Kim through the discovery phase as David Ermold and David Moore push forward with their attempt to bankrupt Kim. But even with this temporary setback, we continue to fight to overturn Obergefell.

The Supreme Court’s refusal to do its job in this case is an aberration from the religious freedom the Constitution ensures for all Americans. Our fight to overturn Obergefell is not over — it is not a matter of if, but when, this wrongly decided opinion will be overturned.

Much like Roe v. WadeObergefell v. Hodges was egregiously wrong from the start and has no basis in the Constitution. Marriage should have never been federalized, and we will continue working with state legislators and individuals to overturn Obergefell and to restore the sanctity of marriage.

This may mark the end of an era in litigating Kim’s case, but the fight to overturn Obergefell and protect religious liberty has just begun. I have no doubt that Kim’s resolve will serve as a catalyst to raise up many more challenges to the wrongly decided Obergefell opinion.

Obergefell is legal fiction pulled out of thin air that jeopardizes the religious liberty of countless Americans who believe in God’s design of marriage between a man and a woman. Obergefell’s days are numbered, and we will not rest until it is overturned.

Until then, we must pray, fight, and contend for when Obergefell is no longer the law of the land.
