SCOTUS Failed to Right its Wrong, But This is Not the End
Liberty Counsel will not rest until Obergefell is overturned.
Last week, the Supreme Court made a heartbreaking decision. By refusing to hear Davis v. Ermold, they closed the door on a decade-long legal battle and left Kim Davis — an American patriot and devout Christian — facing hundreds of thousands of dollars in personal fines. This is a terrible injustice, but Kim has a strong faith. What Kim started 10 years ago will continue.
This is not the end — our fight is not over.
The wrongfully decided Obergefell v. Hodges opinion, in which five lawyers arrogantly thought they could redefine God’s design for marriage, caused this mess. In the past 10 years, Obergefell has served to abrogate religious freedom rights for anyone who refuses to bow to the LGBTQ agenda. Kim Davis was the first, but certainly not the last victim.
We will not rest until this lawless opinion is overturned and religious freedom rights are restored.
Kim Davis never asked to be a national figure. She simply wanted to live out her Christian convictions while serving as the elected county clerk in Rowan County, Kentucky. But when “five lawyers” invented same-sex “marriage” and imposed this on all 50 states in Obergefell v. Hodges, Kim was faced with an impossible choice: violate her deeply held beliefs or seek a religious exemption.
She chose faith. With her broken past radically redeemed by Jesus Christ, she would not be disobedient and rebel against God’s created design.
Kim requested a simple religious accommodation: to remove her name from marriage licenses that contradicted her beliefs. That accommodation was granted — by both Democratic and Republican governors, and later by the Kentucky legislature. And yet, two men, David Ermold and David Moore, continued to pursue a personal vendetta against her. They had already received their license. But they wanted more — they wanted to force Kim to violate her Christian faith and bankrupt her in the process.
Their campaign to punish Kim for her faith led to her being jailed for six days, sued, and now held personally liable for damages. This is not justice. This is religious persecution.
The Supreme Court’s refusal to hear Kim’s case is a chilling signal. It tells us that government officials may be stripped of their constitutional rights simply for standing up for their faith. If this can happen to Kim Davis, it can happen to any of us.

This may mark the end of an era in litigating Kim’s case, but the fight to overturn Obergefell and protect religious liberty has just begun. I have no doubt that Kim’s resolve will serve as a catalyst to raise up many more challenges to the wrongly decided Obergefell opinion.
Obergefell is legal fiction pulled out of thin air and jeopardizes the religious liberty of countless Americans who believe in God’s definition of marriage. Obergefell’s days are numbered, and we will not rest until it is overturned.
Just as we fought to overturn Roe v. Wade, we are committed to overturning Obergefell v. Hodges — an opinion that was egregiously wrong from the start. Marriage should never have been federalized. It is time to return this sacred institution to the states and to the people.
Kim’s courage has ignited a movement. Her story is not over — it is a rallying cry for every American who believes in religious liberty and the sanctity of marriage.
