ACLU Plans to Steamroll Christians

The implications of this ACLU case will affect everyone

The American Civil Liberties Union (ACLU) set up this case for a reason. If they win here, this case will create a domino effect on Christian schools, businesses, and much more.

Jonathan Zinski’s devious plan was to fool Liberty University. When he affirmed Liberty’s Doctrinal Statement, he knew what his plan was. He had been taking female hormones for four months. The Doctrinal Statement says that God created us as “biologically male or female from the womb.” And to identify as anything other than your birth sex is sin.

So right after his 90-day probationary employment period, Zinksi, a biological male, announced his so-called “transition” to “female” and intention to go by the name “Ellenor.” Understandably, the university fired him for flagrantly violating the Doctrinal Statement and compromising the university’s Christian mission.

In our Zinski v. Liberty University case, the lower court effectively ordered this private Christian university to change its doctrine. I am now preparing for oral argument at the Court of Appeals.

Zinski came to work at Liberty University with the intent of setting up the school and retaliating with a “discrimination” lawsuit, backed by the ACLU, nonetheless.

Now that this Christian university is under fire for standing for truth, we are defending Liberty from this baseless attack: Christian institutions absolutely have the right and freedom to hire AND fire in accordance with their religious beliefs and doctrinal statement.

This case is garnering national attention already, and I have the feeling it’s just getting started.

When we filed a reply brief to the Fourth Circuit Court of Appeals in this case in September, multiple universities, faith-based institutions, and legal scholars filed in support of our case. On the other hand, 19 Democrat-run states and the District of Columbia filed in opposition.

In mid-March, I will argue this case in front of the Court of Appeals to defend the religious freedom of Liberty University — and the religious freedom of faith-based institutions nationwide. It’s not just Liberty’s religious freedom the ACLU is after — this extends to churches and religious institutions everywhere and their right to employ individuals who align with the Christian principles they’re founded upon.

It is clear this case was a “set up” from the beginning. Zinski had been taking female hormones for four months before he applied for a job and agreed to abide by Liberty University’s doctrinal statement affirming biblical sexuality.  

The fact that he was actively preparing to “identify” as “female” BEFORE he applied proves that Zinski never had any intention of abiding by the university doctrinal statement he signed. By his own admission, Zinski signed in bad faith with the intention of suing the school at his first opportunity. 

Liberty University had every right to fire him — and so would your church, Christian school, or parish, if faced with a similar situation.   

The First Amendment requires that religious institutions must have the right to hire people who live a life guided by the institution’s doctrine. Religious institutions have the freedom to carry out their core mission. And if an employee’s actions do not comport with that mission, the religious institution must have the right to fire that person.

Zinski’s attempt to “set up” Liberty University for a lawsuit goes far beyond the LGBTQ sideshow he is desperately trying to pull off. Should churches be forced to hire atheists to preach from the pulpit? Obviously not.

It’s really quite simple: Religious institutions should be able to hire in accordance with their religious convictions. By the same measure, a religious institution has the absolute right to fire employees whose actions and behaviors compromise those convictions.
