Prayer Alert: Critical Few Days Ahead

Last week, I had a critical meeting in Washington, D.C., with the U.S. solicitor general’s office regarding our case, Does v. Hochul. This lawsuit challenges New York Governor Kathy Hochul on forcing health care employers to deny all religious exemptions to COVID shots — a blatant violation of federal law and constitutional rights.

Hochul demanded Christians reject their faith or lose their ability to work in her state. Not a single health care worker in New York was granted a religious exemption. Not one!

Following our meeting, we submitted supplemental materials for the United States. Please pray that the solicitor general files a favorable brief that will determine the future of this case.

Here’s the breaking news:

The U.S. Supreme Court asked the solicitor general to file a brief presenting the position of the United States as the Court considers whether to take up our case. This is a major development. If the solicitor general recommends review, we will argue before the High Court this year.

We met with the solicitor general’s office last week. Representatives from the Equal Employment Opportunity Commission (EEOC), the Department of Health and Human Services (HHS), and the Department of Justice (DOJ) Civil Rights and Appellate divisions were also present. All in all, the solicitor general had 15-20 people in that meeting, and I believe that shows the Trump administration has a serious interest in our case.

We prepared additional materials for the solicitor general as they prepare to meet with Gov. Hochul’s team and opposing counsel.

Why This Case Matters

This case is about more than New York. It’s about protecting every American’s right to live out their faith without fear of losing their business, their professional license, and their job.

Just last month, the Supreme Court sent shockwaves through the legal world by vacating a judgment in Miller v. McDonald — a case involving Amish families denied COVID shot exemptions — and ordering a review in light of its decision in Mahmoud v. Taylor. The Court is signaling that religious freedom rights are broader than Gov. Hochul would like to believe.

Last week, in a totally unrelated case where the Supreme Court asked the solicitor general to weigh in, the Court agreed to hear the case almost immediately after having received the solicitor general’s report.

That momentum is good news for our case. But we still have to make these arguments before the Court — and that takes resources. Liberty Counsel never charges clients, because most could never afford to defend their rights all the way to the Supreme Court.
