This lawsuit did not arise accidentally. Jonathan Zinski had already been taking estrogen before applying to Liberty University, yet he signed Liberty’s doctrinal statement affirming biblical teaching on biological sex — a statement he had no intention of honoring.
Once his probationary period ended, he announced his demand to be allowed to “identify” as a “woman” and change his name to “Ellenor” despite knowing his actions directly contradicted Liberty’s biblical doctrine and his own employment commitments. Liberty University acted consistently with its doctrinal expectations and refused to comply — but was immediately met with a lawsuit backed by the ACLU.
The lower court ruling threatens to reshape religious liberty in America. The judge asserted that Liberty cannot “erect a shield against antidiscrimination laws” even when an employee openly defies its religious doctrine.
This interpretation ignores longstanding First Amendment protections and explicit Title VII provisions exempting religious institutions when they make employment decisions based on their religious doctrine.
Next month I will present oral argument before a three-judge panel at the Court of Appeals. This case is eventually headed to the U.S. Supreme Court, where a ruling would be a landmark decision governing the rights of Christian schools and organizations for generations. And that is why Liberty Counsel is preparing an intensive defense — one requiring extensive research and preparation — sustained by your prayers and support.
