Teacher Sues For Reporting Bad Behavior

Parents spoke up about a teacher’s bad behavior. 

Now the teacher is suing the parents' group for reporting her! 

When parents discovered that Jacksonville public school teacher Hope McMath’s vile public social media posts, including posts mocking the assassination of Charlie Kirk, they were shocked.  

Instead of remaining silent, they did what responsible citizens are supposed to do — report them! They reported the teacher's public posts to Moms for Liberty, which then forwarded the concerns to school officials, the Duval County Public Schools (DCPS), and the Florida Department of Education (FDOE) for review. 

So shocking were teacher Hope McMath’s posts that the department suspended her as the investigation continued.

The teacher does not deny that she made the shocking social media posts. She makes no excuses for her behavior. Instead, she is suing Moms for Liberty, which reported her horrific public behavior to the proper authorities

The facts at the heart of this case are straightforward. The social media posts were public. Concerned parents saw them. Moms for Liberty — a parents’ rights group focused on cleaning up public-school systems — accurately shared those publicly available posts with the appropriate authorities.  

School officials then conducted their own review and made their own decisions to take action against this teacher.  

That is exactly how government accountability is supposed to work

But if this lawsuit is allowed to succeed, the consequences will reach far beyond one school district in Florida. Parents everywhere could begin asking themselves, "If I report something that concerns me, will I be the next one sued?" 

That chilling effect is precisely why Florida enacted its Anti-SLAPP law — to stop lawsuits intended to punish citizens for petitioning their government or participating in matters of public concern. 

Liberty Counsel has filed a motion asking the court to dismiss this lawsuit under Florida's Anti-SLAPP (Strategic Lawsuits Against Public Participation) protections. This case is about far more than one lawsuit. This case is about protecting every parent's right to speak up without fear of legal intimidation.
