California Court Stays Marriage Decision While Appeal Is Pending

Mar 31, 2005

San Francisco, CA - State Court Judge Richard Kramer has issued an order staying his March 14 decision that struck down California's marriage laws. The decision will be stayed during the appeal process. Mathew D. Staver, President and General Counsel of Liberty Counsel, and Senior Litigation Counsel, Rena Lindevaldsen, represent Campaign for California Families (CCF). CCF was granted the right to defend the state's marriage laws.

The temporary ruling issued on March 14 will soon be converted to a permanent ruling. Yesterday afternoon, Judge Kramer conducted a conference with all of the parties and indicated he will convert his temporary order into a permanent one in the near future. He also agreed to stay the March 14 decision, thus meaning that the marriage laws will still be enforceable.

Staver commented, "California's marriage laws still preserve marriage as the union of one man and one woman. We intend to ensure that the marriage laws remain unchanged. Marriage is too important an institution to be undermined by the stroke of a pen. The state of California has common sense and compelling reasons for preserving marriage as the union of one man and one woman, not the least of which is procreation, the preservation of the family, and providing a stable environment in the best interest of children."
