Orlando, FL – Today Harriet Miers withdrew her nomination from the United States Supreme Court, a move that was welcomed by Liberty Counsel. On October 11, 2005, Mathew D. Staver, President and General Counsel of Liberty Counsel, issued a public statement asking for Miers to withdraw her nomination, making Liberty Counsel the first organization in the country to officially oppose her nomination to the U.S. Supreme Court. On October 20, WorldNetDaily published a lengthy article written by Mr. Staver which detailed the reasons for Liberty Counsel’s opposition to Harriet Miers. Liberty Counsel is a nationwide, public interest litigation, education and policy organization that specializes in constitutional law.
Staver commented on Miers’ withdrawal: “Although I took heat from some conservatives for opposing the nomination of Harriet Miers to the United States Supreme Court, most of those who urged her nomination have concluded what I expressed early on, namely that the nomination of Miers by the President was a botched decision which was not in keeping with his campaign promise. The 1993 speeches by Miers, made public by the Washington Post yesterday, confirmed what we knew or suspected from the beginning – Harriet Miers does not respect the rule of law and she would not have been a conservative voice on the High Court.”
Staver continued: “The legacy of President Bush lies in the future of the Supreme Court. This nomination is his defining moment. I urge the President to keep his campaign promise to appoint Justices who respect the rule of law and who will remain loyal to the purpose and intent of the Constitution. It is not often that you have the opportunity to correct a bad decision, but this is exactly the opportunity afforded to the President.”
Staver concluded: “Mr. Bush, this is your moment to change history. This is your moment to make a principled decision. If you do the right thing, those who fought so hard for this moment will rise in support. Do not take your conservative base or people of faith for granted again. I urge you to continue the conservative movement to bring the High Court back to the Constitution. There is a solid short list of candidates for the U.S. Supreme Court, and Alberto Gonzales is not on that list.”
