Supreme Court Hears Intense Partial-Birth Abortion Argument

For two hours this morning, the United States Supreme Court heard oral argument regarding the constitutionality of the Partial-Birth Abortion Ban Act of 2003, in Gonzalez v. Carhart and Gonzales v. Planned Parenthood. Liberty Counsel filed amicus briefs in both cases with the Court on behalf of the Association of Pro-Life Physicians and Jill Stanek.

Solicitor General Paul Clement, who defended the Act on behalf of the United States, presented a compelling argument in both cases.

Justice Kennedy will probably cast the deciding vote in these cases. His position on was not clear from his questioning, as he appeared to be carefully considering both positions.

Justices Breyer, Stephens, Souter and Ginsburg were obviously against banning partial-birth abortion. Justice Scalia clearly favored the law. Justice Roberts asked probing questions of both sides, and Justice Alito remained silent. Justice Thomas was absent due to illness, but will participate in the decision.
